How to determine if council consent is needed for your home renovation, alteration or extension

To ensure buildings are safe, healthy and durable all building work must adhere to New Zealand’s Building Code. Many building projects require a building consent. Resource consent and other permits may also be required by your local council.

The following building work typically requires consent:

  • structural building work including additions, alterations, re-piling and some demolitions
  • plumbing and drainage which is used to create additional sanitary fixtures building relocation
  • installation of a woodburner or air-conditioning system
  • retaining walls that are higher than 1.5 metres fences or walls that are higher than 2.5 metres, and fencing for swimming pools
  • decks, platforms or bridges that are more than 1.5 metres above ground level
  • sheds that are greater than 10 square metres in floor area
  • some earthworks

If you don’t have a building consent, and one is required, you are breaking the law. You can be fined up to $200,000. If work continues you can be fined up to $10,000 for every day, or part day, while building continues.

There are three scenarios where consent isn’t needed. 

  1. Work that doesn’t affect the building’s structure or fire safety and that doesn’t pose a risk to public safety is exempt from consent.
  2. People carrying out sanitary plumbing and drainlaying who are authorised under the Plumbers, Gasfitters and Drainlayers Act are also exempt from needing consent.
  3. For building work for which the design is carried out/reviewed by a chartered engineer.

When selling your property, it’s wise that your property file is current and all recent work is noted in the council’s records. You can notify your council of any changes - and provide supporting documents such as any drawings, specifications or photos you have.
